Terms governing access to and use of the Environmental Impact Review Board Public Registry.
1. About these Terms
These Terms and Conditions govern access to and use of the Environmental Impact Review Board (EIRB or Review Board) electronic public Registry (Registry). The Registry includes information and documents relating to environmental impact reviews conducted under the Inuvialuit Final Agreement (IFA).
By accessing, browsing, downloading from, submitting information to, or otherwise using the Registry, you acknowledge that you have read and agree to these Terms. If you do not agree, discontinue use of the Registry.
2. Purpose and status of the Registry
The Registry is the electronic copy of the record of documents established by the EIRB for a proceeding. It supports public access, transparency, participation, and the administration of environmental impact review proceedings.
The Registry may contain project descriptions, referral materials, notices, schedules, work plans, terms of reference, submissions, information requests and responses, technical materials, hearing records, rulings, reports, decisions, correspondence, and other materials relating to a proceeding.
These Terms govern website use. They do not replace or amend the IFA, EIRB Rules of Procedure, Review Guidelines, a development-specific Terms of Reference, a direction, ruling, order, schedule, or work plan issued by the Review Board. If there is a conflict, the applicable authoritative instrument or direction governs.
3. Public record status
Documents on the record are publicly accessible unless the Review Board has authorized filing on a confidential basis. Most documents on the public Registry are also made available online. Materials produced after the close of the public record, including an EIRB report, may still be placed on the Registry.
Information on the Registry may be considered by the Review Board or a Review Panel in carrying out an environmental impact review. Users are responsible for following the applicable proceeding schedule, filing requirements, and directions.
4. Public Notice
PUBLIC RECORD NOTICE
The EIRB Registry is a public record for environmental impact review proceedings conducted under the Inuvialuit Final Agreement. Documents, submissions, correspondence, notices, reports, technical studies, decisions, and other materials filed with the EIRB may be published and made publicly accessible through the Registry as part of the review process.
By submitting information, you acknowledge that it may become part of the public record and may be viewed, downloaded, copied, or referenced by members of the public. Personal information, business information, maps, studies, photographs, Traditional Knowledge, and supporting materials may become publicly available unless the Review Board has authorized confidential filing.
Do not submit confidential, proprietary, commercially sensitive, personal, Traditional Knowledge, or otherwise protected information unless it is necessary for the proceeding and you have followed the applicable process to request confidential treatment. A request for confidential treatment does not by itself guarantee that the information will be withheld from publication.
You are responsible for ensuring that you have authority to submit the information and for identifying information that may require confidential treatment before submission.
Important: Where confidential treatment is required, contact the EIR Coordinator at eirbregistry@jointsec.nt.ca and follow the applicable EIRB Rules of Procedure and any proceeding-specific direction before filing the information.
5. Accuracy, completeness, and currency
The Registry contains information supplied by developers, Parties, government bodies, Indigenous organizations, consultants, individuals, and other external sources. The EIRB does not guarantee the accuracy, completeness, reliability, or currency of information supplied by external sources.
Users should review the full document, its filing context, and any later corrections or updates. Questions about externally supplied information should be directed to the submitting person or organization where appropriate.
6. User responsibilities
You are responsible for your use of the Registry and for complying with applicable laws, these Terms, the EIRB Rules of Procedure, submission standards, and proceeding-specific directions.
- Use the Registry only for lawful purposes.
- Provide accurate information and avoid false, misleading, defamatory, or fraudulent submissions.
- Ensure you have authority and all necessary permissions to file documents, personal information, copyrighted material, Traditional Knowledge, maps, photographs, and third-party information.
- Identify confidential or protected information before submission and use the applicable confidential filing process.
- Maintain the security of any account credentials and promptly report suspected unauthorized access.
- Do not interfere with the operation, security, integrity, or availability of the Registry.
- Do not introduce malicious code, attempt unauthorized access, scrape the Registry in a manner that disrupts service, or circumvent technical or security controls.
- Do not alter, misrepresent, or remove the context, source, authorship, or filing status of Registry material.
7. Submissions and filing requirements
Submitting a document does not guarantee that it will be accepted onto the record, posted immediately, or treated as evidence. The EIRB may review submissions for compliance with applicable filing standards and directions.
The EIRB may return, reject, remove, restrict, reclassify, correct metadata for, or request replacement of a submission that is incomplete, unreadable, duplicative, outside the scope of a proceeding, contrary to a direction, unlawful, unsafe, or otherwise unsuitable for the Registry.
A submitter must retain an authoritative copy of each filed document. The date and time shown by the Registry or confirmed by the EIRB will govern where filing deadlines apply, subject to any direction or ruling of the Review Board.
8. Confidential and protected information
A Party seeking confidential treatment must follow the applicable EIRB Rules of Procedure and obtain authorization from the Review Board to file on a confidential basis. Information should not be assumed confidential merely because it is marked confidential or accompanied by a request.
Where appropriate, submitters should provide a public, redacted version that removes only the information authorized for confidential treatment. The EIRB may require further information or a revised version before accepting a confidential filing.
Traditional Knowledge is Inuvialuit intellectual property and must be respected and managed accordingly. Users must not remove Traditional Knowledge from its cultural context or use it contrary to any restrictions, protocols, consent conditions, or directions associated with the information.
9. Personal information and privacy
The EIRB collects, uses, stores, publishes, and discloses information for the purpose of administering environmental impact review proceedings and maintaining the Registry, subject to applicable law, EIRB policy, and procedural requirements.
Because the Registry is public, users should provide only personal information that is necessary for the proceeding. Submitters should avoid unnecessary personal contact information, identification numbers, signatures, financial account information, health information, or other sensitive personal information.
The EIRB Privacy Policy provides additional information about personal information practices. Where these Terms and the Privacy Policy address the same matter, they should be read together.
10. Copyright and permitted use
Copyright in Registry content may belong to the EIRB, the submitting party, the author, or another rights holder. Public availability does not transfer ownership or waive copyright, moral rights, Indigenous intellectual property rights, confidentiality obligations, license restrictions, or other rights.
Users may view, download, print, and cite Registry material for participation in an EIRB proceeding, research, education, personal use, or other lawful non-commercial use, provided the source is acknowledged, the material is not presented misleadingly, and all notices and restrictions are preserved.
Permission from the rights holder may be required for commercial reuse, republication, adaptation, redistribution, or any use beyond an applicable legal exception or license.
11. Acceptable citation and context
When referring to Registry material, users should identify the document title, submitter or author where shown, project or proceeding, filing date, and Registry reference where available. Users must not represent a draft as final, a submission as an EIRB finding, or an EIRB recommendation as a final government authorization.
12. Registry access and availability
The EIRB seeks to maintain access to the Registry but does not guarantee uninterrupted, error-free, or continuous availability. Access may be limited or suspended for maintenance, upgrades, security, legal compliance, operational requirements, or circumstances beyond the EIRB’s control.
The EIRB may modify the Registry’s structure, features, formats, search functions, and technical requirements. The official status of a record is not affected solely because an electronic copy is temporarily unavailable.
13. Security
Users must not attempt to gain unauthorized access to accounts, systems, databases, or non-public records. Suspected vulnerabilities, unauthorized access, malicious content, or privacy incidents should be reported promptly to the EIRB and must not be exploited or publicly disclosed in a manner that increases risk.
14. Third-party links and software
The Registry may link to third-party websites, documents, mapping services, software, or resources. The EIRB does not control third-party services and is not responsible for their availability, content, security, accessibility, or privacy practices. A link does not constitute endorsement.
15. Disclaimer and limitation of liability
The Registry and its content are provided for public access and participation in EIRB proceedings. Registry content is not legal, regulatory, technical, or professional advice and should not be relied upon as a substitute for the applicable authoritative document or professional advice.
To the extent permitted by law, the EIRB, its members, staff, contractors, and service providers are not liable for loss or damage arising from use of or inability to use the Registry, reliance on externally supplied information, service interruption, technical error, malware introduced by a third party, or unauthorized access beyond the EIRB’s reasonable control.
Nothing in these Terms limits any responsibility or liability that cannot lawfully be excluded or limited.
16. Monitoring, enforcement, and access restrictions
The EIRB may monitor use of the Registry for security, administration, compliance, and service improvement. Where misuse is suspected, the EIRB may investigate, preserve relevant records, restrict or terminate access, remove or quarantine content, and refer a matter to appropriate authorities.
A restriction imposed under these Terms does not prevent a person from participating in an EIRB proceeding through another method authorized by the Review Board.
17. Changes to these Terms
The EIRB may amend these Terms from time to time. The current version will be posted on the Registry with its effective date. Continued use after the effective date of amended Terms constitutes acceptance of the amended Terms.
18. Governing framework
These Terms are governed by the laws applicable in the Northwest Territories and Canada and must be interpreted consistently with the Inuvialuit Final Agreement and the EIRB’s lawful authority, Rules of Procedure, Review Guidelines, and proceeding-specific directions.
